Fishers to Enforce New Fireworks Ordinance

In an effort to balance the use of consumer fireworks with resident safety and quality of life, the Fishers Town Council passed a new Fireworks Ordinance on April 15. The new ordinance allows residents to enjoy Consumer Fireworks within the town while also mitigating personal injury, property damage and noise caused by Consumer Fireworks.

A Consumer Firework is a small firework that is designed primarily to produce visible effects by combustion. Consumer Fireworks include, but may not be limited to the following:
Aerial devices, which include sky rockets, missile type rockets, helicopter or aerial spinners, roman candles, mines, and shells.
Ground audible devices, which include firecrackers, salutes, and chasers.
Firework devices containing combinations of the effects described above.

The following items are excluded from the definition of Consumer Fireworks, but will continue to be subject to applicable permitting requirements and state statutes governing fireworks:
Sparklers, fountains (cylindrical and cone), illuminating torches, wheels, ground spinners, snakes or glow worms, smoke devices, and trick noisemakers.

Below is a list of the lawful dates and times to use or display Consumer Fireworks within town limits. The use of Consumer Fireworks on any time or day other than the following will be subject to a fine of $150 for the first offense and $250 for each subsequent offense:
Between the hours of 5 p.m. and two hours after sunset on June 29 through July 3 and July 5 through July 9
Between the hours of 10 a.m. and midnight on July 4
Between the hours of 10 a.m. on December 31 and 1 a.m. on January 1

Enforcement of the new Fireworks Ordinance is currently in effect and being tasked by the Fishers Department of Fire and Emergency Services and the Fishers Police Department. This ordinance will not apply to supervised public displays of fireworks by municipalities, fair associations, amusement parks, and other organizations or groups of individuals, all of which will continue to be subject to applicable permitting requirements and state statutes.
